Section 1
Know Your Rights First ▾

Under the new scheme, articleship is 2 years. Transfer rules are completely different depending on when you apply. Most principals count on you not knowing this.

Free — no reason required

This guide applies to students under CA New Scheme 2023 (2-year articleship). If registered before July 2023, you’re on the old scheme — transfer principles are similar but regulation references may differ.

Step-by-Step Transfer Process ▾

When everything goes smoothly — principal cooperates, both parties agree — this is the exact process.

Before You File
Inform your principal in writing

Do not start with a verbal conversation. Give written notice of your intent. Keep an acknowledged copy. This creates the paper trail you’ll need if things get difficult.

Give adequate notice — 2 to 4 weeks is professional. Do not walk out without warning.

Find New Firm First
Secure your new principal before filing

Do not terminate without a confirmed new firm. There is a strict 30-day window to re-register after termination. Missing it causes compliance issues and may affect CA Final eligibility.

Get a written acceptance letter from the new principal before you file Form 109.

ICAI SSP Portal
File Form 109 on eservices.icai.org

Go to Article Functions → Articleship → Transfer / Termination. Your principal must approve on their SSP login. For Year 2, attach supporting documents with the form.

After Approval
Register with new principal within 30 days

Once Form 109 is approved, immediately file Form 102 (Deed of Articles on ₹100 stamp paper) and Form 103 (Registration) on the SSP portal. Time already served counts — you do not restart from zero.

ICAI’s official policy on disputes: “Settle amicably. The Institute shall not interfere.” You cannot wait passively for ICAI to act. You need a documented trail that forces a response. The steps below build exactly that trail.

Frequently Asked Questions ▾
Does a first-year transfer affect CA Final eligibility? ▾
No. A properly approved transfer has zero impact on CA Final eligibility. Time served counts toward your 2-year total — you do not restart. The key: Form 109 approved + Form 103 with new firm filed within 30 days.
Can my principal file a complaint against me for leaving? ▾
A principal cannot file a valid complaint against a student exercising their legal right under Regulation 56(1). If you gave written notice and followed due process, you are protected. Keep all documentation of every step.
I’m in Year 2. My principal isn’t paying stipend. Can I transfer? ▾
Yes. Non-payment or irregular payment of stipend under Regulation 67 is a valid ICAI-approved reason in Year 2. Gather proof — bank statements, messages about payment delays. File Form 109 with documentation and request prior ICAI approval.
What is the 30-day re-registration window and what if I miss it? ▾
After Form 109 is approved, you have 30 days to file Form 103 with the new principal. Missing it requires a late fee + condonation request. In extreme delays, the gap period may not count toward your 2 years. This is why confirming the new firm before filing Form 109 is critical.
What is Form 120 and when should I use it? ▾
Form 120 is a declaration of discontinuance filed on the SSP portal without the principal’s signature. It’s a last resort when the principal refuses to sign Form 109. ICAI officially contacts the principal after filing. One condition: you cannot re-register with a firm within 50 km of the current principal’s office.
ICAI regional office is also not responding. What now? ▾
Escalate to the Disciplinary Directorate at ICAI Bhawan, Noida (Step 5). You can also write directly to the Secretary, ICAI at icai@icai.in with a clear timeline of all steps taken. The Disciplinary Directorate has more authority than the regional office for cases of clear professional misconduct.
How many transfers am I allowed? ▾
ICAI doesn’t specify a maximum. But multiple transfers without strong reasons can raise questions at Big 4 interviews and complicate your ICAI records. The Year 1 right is meant to correct a wrong choice — use it thoughtfully.
